1. About these terms
This online store is operated by Karpati Natural Pty Ltd (ABN 53 746 020 232), trading as Eva Karpati Skin Clinic ("we", "us", "our"). These terms apply when you browse our website or buy products from us online. By placing an order, you agree to these terms, our Privacy Policy, our Refund Policy and our Shipping Policy.
Clinic treatments, consultations and programs are booked separately and are covered by the terms you receive when you book, not by these terms.
2. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Where those laws let us limit our liability, our liability is limited to replacing the products, supplying equivalent products, or paying the cost of doing either.
3. Products and information
We take care to describe and show our products accurately, but colours and packaging may look slightly different on your screen. Product information on this site is general and isn't a substitute for personal advice from a health professional. Please read the full ingredient list before use and patch-test if you have sensitive skin or known allergies.
4. Orders
When you place an order, you're making an offer to buy. We'll email you to confirm we've received it. A contract is formed when we dispatch your order. We may decline or cancel an order, for example if a product is out of stock, a price is clearly wrong, or we suspect fraud. If we cancel an order you've paid for, we'll refund you in full.
Our products are sold for personal use, not for resale.
5. Prices and payment
All prices are in Australian dollars and include GST. Shipping costs are shown at checkout before you pay. Prices and promotions can change without notice, but the price you pay is the one shown when you place your order. Promotions and discount codes are subject to their own conditions and can't be exchanged for cash.
6. Shipping, returns and refunds
Delivery is covered by our Shipping Policy. Returns and refunds are covered by our Refund Policy. Risk in products passes to you on delivery.
7. Your account
If you create an account, you're responsible for keeping your login details secure and for activity on your account. Please make sure the information you give us is accurate and up to date.
8. Intellectual property
All content on this site, including the EVA KARPATI name and logo, text, images and design, belongs to us or our licensors and is protected by Australian and international law. You may use the site for your own personal, non-commercial purposes only.
9. Acceptable use
You must not use this site unlawfully, interfere with its security or operation, scrape or copy its content in bulk, or use it to send spam or harmful code. Automated tools or agents that access the site must identify themselves and must not bypass any measures we use to manage automated access.
10. Reviews and feedback
If you send us feedback or post a review, you let us use it to run and improve our business. Reviews must be honest and your own. We may remove content that is unlawful, misleading or offensive.
11. Third-party links and tools
Our site may link to or include tools from third parties (such as payment providers and booking systems). We aren't responsible for their content or practices, so please review their terms and privacy policies.
12. Relationship with Shopify
This store is powered by Shopify, which enables us to provide our online services. Any sales and purchases you make in our store are made directly with Karpati Natural Pty Ltd. By using the store, you acknowledge that Shopify is not responsible for any aspect of any sale between you and us, including any injury, damage or loss resulting from purchased products, and you release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with us. Your use of Shopify-provided features is also subject to Shopify's Consumer Privacy Policy.
13. Privacy
We handle your personal information in line with our Privacy Policy and the Privacy Act 1988 (Cth).
14. Changes to these terms
We may update these terms from time to time. The version on this page when you place an order is the one that applies to that order.
15. Governing law
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
